Terms of Service

Please read these terms carefully before using our services. By subscribing to or using AIEAAS, you agree to these terms.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and AIEAAS, operated by Eddie Burroughs ("AIEAAS," "we," "us," or "our"), located in North Carolina, USA.

By creating an account, subscribing to a plan, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use our services.

2. Description of Services

AIEAAS provides the following services to local businesses:

  • AI Employees — 24/7 AI-powered call answering, appointment scheduling, and customer engagement that operates on behalf of your business.
  • Custom Websites — Professional website design and development tailored to your business.
  • SEO Services — Search engine optimization to improve your online visibility and local search rankings.
  • AI Chatbots — Intelligent chat widgets for your website that engage visitors and capture leads.
  • Reputation Management — Monitoring, responding to, and building your online reviews and brand presence.

Specific features and service levels depend on your selected plan. We reserve the right to modify, update, or discontinue any service feature with reasonable notice.

3. Account Responsibilities

To use our services, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Providing accurate business information for your AI employee to use when interacting with your customers.
  • Notifying us immediately of any unauthorized use of your account.

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business.

4. Billing and Payments

Our services are billed on a monthly subscription basis, starting at $147 per month. By subscribing, you agree to the following:

  • Recurring Billing — Your subscription will automatically renew each month at your plan's rate. You will be charged on the same date each billing cycle.
  • Payment Method — You authorize us to charge the payment method on file for all subscription fees. Payments are processed securely through Stripe.
  • Price Changes — We may adjust pricing with at least 30 days' written notice before your next billing cycle. Continued use after a price change constitutes acceptance.
  • Failed Payments — If a payment fails, we will attempt to process it again. After repeated failures, your service may be suspended until the balance is resolved.
  • Cancellation — You may cancel your subscription at any time by contacting us at info@aieaas.com. Cancellation takes effect at the end of your current billing cycle. No refunds are issued for partial months.
  • Refunds — We offer a 30-day satisfaction guarantee for new subscribers. If you are not satisfied within your first 30 days, contact us for a full refund.

5. Acceptable Use

You agree to use our services only for lawful business purposes. You must not use AIEAAS services, including AI employees, chatbots, or any platform features, to:

  • Engage in any illegal activity or promote illegal products or services.
  • Send spam, unsolicited messages, or make harassing or threatening communications.
  • Mislead, defraud, or deceive callers, customers, or any third parties.
  • Transmit harmful, offensive, or discriminatory content through AI interactions.
  • Violate any applicable local, state, or federal laws or regulations, including telemarketing and consumer protection laws.
  • Interfere with or disrupt our platform, servers, or networks.
  • Attempt to reverse-engineer, copy, or resell our AI technology or services.

We reserve the right to suspend or terminate your account immediately if we determine that you have violated these acceptable use terms.

6. AI Disclosure and Limitations

Our AI employees act on behalf of your business when answering calls, responding to chats, and engaging with your customers. By using our service, you acknowledge and agree to the following:

  • AI employees are automated systems, not human agents. They use artificial intelligence to process and respond to customer inquiries.
  • You are responsible for ensuring that the use of AI employees complies with any disclosure requirements in your industry or jurisdiction.
  • While our AI technology is designed to be accurate and helpful, it may occasionally produce incorrect, incomplete, or unexpected responses.
  • AIEAAS is not liable for any damages, losses, or consequences resulting from AI-generated content, responses, or actions taken by AI employees on behalf of your business.
  • You are responsible for reviewing and monitoring AI interactions and promptly notifying us of any issues.

7. Intellectual Property

All content, technology, software, trademarks, and branding associated with AIEAAS are the exclusive property of AIEAAS and are protected by applicable intellectual property laws.

  • Our Property — The AIEAAS platform, AI models, website templates, tools, and related technology remain our property. Your subscription grants you a limited, non-exclusive, non-transferable license to use our services during your active subscription.
  • Your Content — You retain ownership of your business information, logos, and content that you provide to us. By providing this content, you grant us a license to use it solely for the purpose of delivering our services to you.
  • Custom Websites — Websites built by AIEAAS for your business become your property upon full payment. However, proprietary AIEAAS tools, templates, and AI integrations embedded in the site remain our intellectual property.

8. Limitation of Liability

To the maximum extent permitted by law:

  • AIEAAS provides its services on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.
  • We do not guarantee that our services will be uninterrupted, error-free, or that AI-generated responses will be accurate in all cases.
  • AIEAAS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities.
  • Our total liability for any claim arising out of or related to these Terms or our services shall not exceed the amount you paid to AIEAAS in the three (3) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless AIEAAS, its owner, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of our services.
  • Content or information you provide to us or that is communicated through your AI employee.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.

10. Termination

Either party may terminate this agreement as follows:

  • By You — You may cancel your subscription at any time by contacting us. Your access will continue until the end of your current billing cycle.
  • By Us — We may suspend or terminate your account immediately if you violate these Terms, engage in prohibited conduct, or fail to pay outstanding fees after notice.

Upon termination, your access to our services will cease. We will retain your data for up to 90 days, after which it will be securely deleted unless required by law. You may request an export of your data prior to deletion.

11. Dispute Resolution

If a dispute arises between you and AIEAAS, we encourage you to first contact us at info@aieaas.com to attempt to resolve the matter informally. If we are unable to reach a resolution, both parties agree to resolve any disputes through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in North Carolina.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against AIEAAS.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any legal proceedings arising out of or related to these Terms shall be brought exclusively in the courts located in North Carolina.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page and, for material changes, notify you via email or through our platform. Your continued use of our services after changes take effect constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
